New York Tax Attorney Warns About The Rise Of Tax Resolution Scams

Given the difficult economic climate, New York taxpayers often fall behind on income taxes due to circumstances beyond their control. Many taxpayers may fall behind on the payment of income taxes due to a loss of job, medical expenses, or a divorce. The IRS begins chasing the taxpayer for unpaid back taxes and the nervous taxpayer looks for a solution.

If you owe the IRS money for back taxes and a federal tax lien has been filed, you will most likely receive a phone call or letter from an out of state tax resolution firm claiming that they can miraculously settle your IRS tax problems. Unfortunately, tax relief scam firms often leave desperate taxpayers worse off than they were before so beware of these tax relief scams. Beware of official looking direct mail and telemarketing calls from tax resolution firms. Many of these firms are based in California and Colorado as many high pressure tax resolution sales organizations sprouted in Colorado and spread, like a disease, to other states.

As a local New York tax attorney, many of my clients often come to me after a tax resolution company has scammed them out of thousands of dollars. Many of my clients are shocked to learn that most of these tax resolution outfits are not even owned or operated by attorneys or accountants. Rather, many of these tax resolution firms are run by salesman just interested in making as much money as possible preying on taxpayers who are terrified of the IRS. Tax resolution firms then hire attorneys, accountants, and enrolled agents to “rubber stamp” their proposals.

This is how the boiler room tax resolution sales scam often works. Once a federal tax lien has been filed against you or your company by the IRS, your IRS tax matter becomes a matter of public record. Soon thereafter, you will begin to receive calls and letters from commissioned salesmen disguised as “tax relief consultants,” or “tax resolution agents.” Before you hire one of these tax resolution firms, do your homework and download our free IRS Tax Problem Help Guide at our website. Our guide has a list of questions to ask any tax attorney, accountant, or tax resolution firm you are considering hiring.

Further, many tax resolution firms dispense bad advice and often tell taxpayers that they will qualify for an Offer in Compromise when it is clear that they will not. An Offer in Compromise is when the IRS accepts a small fraction of the amount that the taxpayer owes them. Let’s face it, everyone wants to settle for less and the salesperson knows that’s what you want to hear. While the rules for an Offer in Compromise have recently become more favorable to taxpayers, not everyone qualifies and a detailed analysis by a tax professional is necessary before you throw good money after bad.
